There is something to be appreciated about a politician who thinks.
Sure, every politician does some kind of thinking – whether it be to vote a piece of legislation up or down, visit a particular electoral district, or even who to hire for their campaign staff. But it’s the real, contemplative, philosophical kind of thinking I’m talking about here. The kind of thinking that causes a man to dig deep down in the spine of his worldview and bring up the kinds of beliefs that make him who he really is. I fear far too many of our modern day politicians rarely make these kinds of philosophical forays into the depths of their own souls. Ron Paul, however, is not your typical politician. But don’t take my word for it. Listen to how he works out his own Christian faith in the arena of politics and law:

“As we celebrate another Yuletide season, it’s hard not to notice that Christmas in America simply doesn’t feel the same anymore. Although an overwhelming majority of Americans celebrate Christmas, and those who don’t celebrate it overwhelmingly accept and respect our nation’s Christmas traditions, a certain shared public sentiment slowly has disappeared. The Christmas spirit, marked by a wonderful feeling of goodwill among men, is in danger of being lost in the ongoing war against religion.
Through perverse court decisions and years of cultural indoctrination, the elitist, secular Left has managed to convince many in our nation that religion must be driven from public view. The justification is always that someone, somewhere, might possibly be offended or feel uncomfortable living in the midst of a largely Christian society, so all must yield to the fragile sensibilities of the few. The ultimate goal of the anti-religious elites is to transform America into a completely secular nation, a nation that is legally and culturally biased against Christianity.
This growing bias explains why many of our wonderful Christmas traditions have been lost. Christmas pageants and plays, including Handel’s Messiah, have been banned from schools and community halls. Nativity scenes have been ordered removed from town squares, and even criticized as offensive when placed on private church lawns. Office Christmas parties have become taboo, replaced by colorless seasonal parties to ensure no employees feel threatened by a “hostile environment.” Even wholly non-religious decorations featuring Santa Claus, snowmen, and the like have been called into question as Christmas symbols that might cause discomfort. Earlier this month, firemen near Chicago reluctantly removed Christmas decorations from their firehouse after a complaint by some embittered busybody. Most noticeably, however, the once commonplace refrain of “Merry Christmas” has been replaced by the vague, ubiquitous “Happy Holidays.” But what holiday? Is Christmas some kind of secret, a word that cannot be uttered in public? Why have we allowed the secularists to intimidate us into downplaying our most cherished and meaningful Christian celebration?
The notion of a rigid separation between church and state has no basis in either the text of the Constitution or the writings of our Founding Fathers. On the contrary, our Founders’ political views were strongly informed by their religious beliefs. Certainly the drafters of the Declaration of Independence and the Constitution, both replete with references to God, would be aghast at the federal government’s hostility to religion. The establishment clause of the First Amendment was simply intended to forbid the creation of an official state church like the Church of England, not to drive religion out of public life.
The Founding Fathers envisioned a robustly Christian yet religiously tolerant America, with churches serving as vital institutions that would eclipse the state in importance. Throughout our nation’s history, churches have done what no government can ever do, namely teach morality and civility. Moral and civil individuals are largely governed by their own sense of right and wrong, and hence have little need for external government. This is the real reason the collectivist Left hates religion: Churches as institutions compete with the state for the people’s allegiance, and many devout people put their faith in God before their faith in the state. Knowing this, the secularists wage an ongoing war against religion, chipping away bit by bit at our nation’s Christian heritage. Christmas itself may soon be a casualty of that war.”




Hmm. Perhaps Mr. Paul was offering thoughtful, philosophical views or perhaps he was pandering to religious conservatives. Regardless, his views are profoundly mistaken.
The principle of separation of church and state is derived from the Constitution (1) establishing a secular government on the power of the people (not a deity), (2) saying nothing to connect that government to god(s) or religion, (3) saying nothing to give that government power over matters of god(s) or religion, and (4), indeed, saying nothing substantive about god(s) or religion at all except in a provision precluding any religious test for public office and the First Amendment provisions constraining the government from undertaking to establish religion or prohibit individuals from freely exercising their religions.
James Madison, who had a central role in drafting the Constitution and the First Amendment, confirmed that he understood them to “[s]trongly guard[] . . . the separation between Religion and Government.” Madison, Detached Memoranda (~1820). He made plain, too, that they guarded against more than just laws creating state sponsored churches or imposing a state religion. Mindful that even as new principles are proclaimed, old habits die hard and citizens and politicians could tend to entangle government and religion (e.g., “the appointment of chaplains to the two houses of Congress” and “for the army and navy” and “[r]eligious proclamations by the Executive recommending thanksgivings and fasts”), he considered the question whether these actions were “consistent with the Constitution, and with the pure principle of religious freedom” and responded: “In strictness the answer on both points must be in the negative. The Constitution of the United States forbids everything like an establishment of a national religion.”
It is important to distinguish between the “public square” and “government” and between “individual” and “government” speech about religion. Contrary to Mr. Paul’s suggestion, the principle of separation of church and state does not purge religion from the public life–far from it. Indeed, the First Amendment’s “free exercise” clause assures that each individual is free to exercise and express his or her religious views–publicly as well as privately. The Amendment constrains only the government not to promote or otherwise take steps toward establishment of religion. As government can only act through the individuals comprising its ranks, when those individuals are performing their official duties, they effectively are the government and thus should conduct themselves in accordance with the First Amendment’s constraints on government. When acting in their individual capacities, they are free to exercise their religions as they please.
Mr. Paul appeals to the religious views of various founders. While those views are subjects of some uncertainty and controversy, it is safe to say that many founders were Christian of one sort or another and that their religions influenced their policy and political views. In assessing the nature of our government, though, care should be taken not to make too much of various founders’ individual religious beliefs. Their individual beliefs, while informative, are largely beside the point. Whatever their religions, they drafted a Constitution that plainly establishes a secular government and separates it from religion as noted above. This is entirely consistent with the fact that some founders professed their religiosity and even their desire that Christianity remain the dominant religious influence in American society. Why? Because religious people who would like to see their religion flourish in society may well believe that separating religion and government will serve that end and, thus, in founding a government they may well intend to keep it separate from religion. It is entirely possible for thoroughly religious folk to found a secular government and keep it separate from religion. That, indeed, is just what the founders did.
While the First Amendment undoubtedly was intended to preclude the government from establishing a national religion as Mr. Paul notes, that was hardly the limit of its intended scope as he suggests. The first Congress debated and rejected just such a narrow provision (“no religion shall be established by law, nor shall the equal rights of conscience be infringed”) and ultimately chose the more broadly phrased prohibition now found in the Amendment. In keeping with the Amendment’s terms and legislative history and other evidence, the courts have wisely interpreted it to restrict the government from taking steps that could establish religion de facto as well as de jure. Were the Amendment interpreted merely to preclude government from enacting a statute formally establishing a state church, the intent of the Amendment could easily be circumvented by government doing all sorts of things to promote this or that religion–stopping just short of cutting a ribbon to open its new church.
The Constitution embodies the simple, just idea that each of us should be free to exercise his or her religious views without expecting that the government will endorse or promote those views and without fearing that the government will endorse or promote the religious views of others. By keeping government and religion separate, the establishment clause serves to protect the freedom of all to exercise their religion. Reasonable people may differ, of course, on how these principles should be applied in particular situations, but the principles are hardly to be doubted.

Posted by Doug Indeap | May 15, 2011, 7:38 pmI think the historical force lies in arguments of broader theological climates, such as those which theologians such as Kuyper and Schaeffer commented on, namely that the ideals of liberty and democracy can best be understood as the fruitful effects of deep Judeo-Christian roots. No charge of pandering is required, merely honest admittance.
